Our terms and conditions apply to all of our services directly or indirectly, including service made available online, by mobile devices, e-mail, live support or by telephone.
These Terms of Use govern the terms and conditions of the usage of the Platform, regardless of whether you become a registered user or a person who requests the booking of a travel itinerary via the Platform.
The platform and service provided are owned, operated and provided by TripCreator subject to the terms and conditions set out below including the privacy statement.
Acceptance of Terms
By using the Platform, you confirm that you have read and understood both these Terms of Use and the Privacy Policy and that you accept and agree to the Terms of Use and the Privacy Policy. If you do not agree to these Terms of Use and the Privacy Policy, you are not authorised to use the Platform.
Use of the Platform
By using the Platform, you represent and warrant that you (i) are at least 18 years of age, (ii) possess the legal authority to create a legally binding obligation and (iii) that you will use the Platform in accordance with these Terms of Use.
Contractual Relationship
You understand and agree that the Platform merely is a platform that enables you to view and book offerings provided by the Suppliers and suggest places that you might find interesting based on the keywords you provided. Upon booking an offering, you are entering a direct contractual relationship with the respective Supplier(s).
To clarify, TripCreator is not a contractual party in any booking. The sole service of TripCreator is to enable Suppliers to sell their offerings via the Platform and to allow you to view the offerings of different Suppliers.

Registration and Accounts
Registration Process
You can browse the Platform, create a travel itinerary and configure it at any time without registering as a user. If you decide to book your travel itinerary, you need to register for a user account.
When you register for a user account, you must provide correct and truthful information and to update the information in the event of any changes.
You can only open one user account. You are not permitted to give any third party access to your user account or to your registration data. Your privacy is important to us. With respect to your user data and its confidential treatment, the provisions of the Icelandic Data Protection Act and the Privacy Policy apply.
Account Restrictions
The travel itineraries and other services offered on the Platform may be reserved for persons who are at least eighteen (18) years old. Therefore, accounts may only be obtained and used if you are at least eighteen (18) years old.
By opening an account, you warrant that no minors are able to access or use your account. You are responsible for your account and shall take all necessary and appropriate measures to prevent access by minors to your account.
Duty to Protect Your Own Computer
We can in no way guarantee that you will have perfect reception and/or availability of the Platform, as the availability of the Platform depends on your computer and your own Internet connection. It is especially important that you make sure that your computer is adequately protected against third-party intrusions and technical attacks that use your computer, your system or your account to spread viruses, spyware or other damaging programs.
Account Termination
In the event of unauthorised use of the Platform or a material breach by you of these Terms of Use or the Booking Terms, we may, at our discretion and without any liability or obligation to refund any costs to you and with immediate effect: (a) terminate your access to the Platform; (b) deactivate or delete any of your accounts and all related information and files in such accounts as well as your content; and (c) bar your access to any of such files or content.
Content on the Platform
Responsibility
You understand and agree that all reviews, postings, messages, text, files, images, photos, video, sounds or other material which are related to Tours posted on, transmitted through or linked from the Platform by Suppliers are the sole responsibility of the Supplier from whom such content originates.
Liability
TripCreator provides you with an unfiltered access to the Platform’s content. You understand and agree that we disclaim all liability related to content that is posted on the Platform by Suppliers, whether arising under intellectual property laws, libel, privacy, obscenity, or otherwise. We cannot, nor do we undertake any obligation to, always control the content that is posted on the Platform.
For obvious reasons, the information on the Platform is changed frequently, may be inaccurate and in some cases may be mislabelled or deceptively labelled. We do not make any representation or warranty, express or implied, as to the accuracy, timeliness or completeness of such information, nor do we undertake to verify, update or correct such information. We recommend that you verify that all information you obtain from the Platform is accurate, complete and up to date.
The TripCreator website makes information of third party content available including, texts, articles, images, locations, opening hours, entrance fees, GPS coordinates and other data. The provision of third Party Content is for general information purposes only. The third party content provided is obtained from sources believed to be reliable and no guarantees are made by the TripCreator website as to its accuracy, completeness or timeliness.
TripCreator is not liable for any damages caused by computer viruses, spyware and other malicious computer programs.
Right to Use
Users are granted a limited, revocable, non-exclusive right to access the Platform for their personal use. All usage should be in accordance with these Terms of Use.
Any other use of the Platform is expressly prohibited. Importantly, the right of use of the Platform does not include any right of collection, aggregation, copying, duplication, display or derivative use of the Platform nor any right of use of data mining, robots, spiders or similar data gathering and extraction tools without our prior written permission.
Changes to the Platform
We reserve the right to change the content, structure, functions, etc. of the Platform, to add new functions, to partially or fully suspend existing content and functions temporarily or permanently, as well as to attach selected functions to the fulfilment of certain conditions, at any time and without notice.

TripCreator reserves the right to update (add or change) these Terms of Use at any time without prior notice. The most current version of the Terms of Use is available here.
Invalidity
If any provision or part of a provision of these Terms of Use is found by any court or authority of competent jurisdiction to be unlawful, otherwise invalid or unenforceable, such provision or part of a provision will be deleted from these Terms of Use and the remainder of these Terms of Use will apply as if the deleted provision or part of the provision had never been agreed.
Assignment
You do not have permission not transfer any of your rights or obligations under these Terms of Use without written consent from TripCreator. We reserve the right to transfer any of the TripCreator rights or obligations under these Terms of Use without your prior written consent.
Applicable Law and Jurisdiction
These Terms of Use and any use of the Platform is exclusively subject to Icelandic law.
Any dispute arising out of or in connection with these Terms of Use shall be submitted to the exclusive jurisdiction of the District Court of Reykjavik, Iceland.
